Until recently Spain lacked specific legislation for the type of services we provide in relation to flights UAVs (UAV). But since leaving the BOE 5 July 2014 No. 163 an interim regulations for this type of commercial flights, at section 6th Article 50, we are already allowed to operate while the law is constantly evolving. It is crucial therefore to know the law and hire this kind of commercial services with reputable companies that comply with the same. In brief summary:

  • Scientific advances have contributed to the progress of aviation allowing the emergence of new airspace users as drones, PSUR (Remotely Piloted Aircraft) o UAVs (Unmanned Aerial Vehicle).
  • These provisions are temporary and are completed in the general scheme of the Act 48/1960, of 21 July Air Navigation.
  • The operation of civil aircraft is piloted remotely addresses only weighing less than 150 Kg. and those of higher weight for activities Firefighting and Rescue.
  • Civil remotely piloted aircraft with a maximum take-off mass exceeding 25 Kg. must be entered in the register of aircraft registration and airworthiness certificate available.
  • All civil aircraft piloted by remote control shall have affixed to its structure legible identification plate, visible and indelible identifying the aircraft and the operator name and contact details.
  • Civil remotely piloted aircraft with a maximum take off mass not exceeding 25 Kg. can only operate outside controlled space and clusters of buildings or settlements, within visual range of the pilot, no mayor a 500 m. and to a maximum of 400 feet (120 m.) from ground level.
  • Additionally, and specifically for aircraft weighing less than 2 Kg., the operator must always have the means to know the position of the aircraft and the flight is subject to the issuance of a NOTAM prior to report the transaction to the other users.
  • Aircraft exceeding those 25 Kg. may only operate with the conditions and limitations established in its certificate of airworthiness issued by the State Agency for Aviation Safety.
  • All providers of these services requires obligatorily:
    • Having an insurance policy against third party liability.
    • Provide documentation on the characterization of aircraft used and operations manual operator procedures.
    • Make an aeronautical study of safety and flight tests necessary to demonstrate that the proposed operation can be performed with sufficient certainty.
    • Having a maintenance program for the aircraft.
  • Pilots must prove the following:
    • Have 18 years of age or older.
    • Having a medical certificate in accordance with the provisions of the regulations.
    • Be holders of any pilot license including ultralight, issued pursuant to the regulations, and satisfactorily demonstrate how they have the necessary knowledge.
    • Arrange for aircraft maximum take off mass not exceeding 25 Kg. a basic certificate for piloting civil aircraft piloted by remote control, issued by an approved training organization.
  • Performing these activities requires communication EASA a minimum of 5 days informing the operator identification data, Description of the characterization of the aircraft using, the type of technical work in developing and operating characteristics and the conditions or restrictions of the flight to ensure safety.
